The Voice of the Child under the Children (Scotland) Act 1995: Giving due regard to children's views in all matters that affect them
The Scottish Executive, CRU Legal Studies Branch funded this feasibility study. It was a partnership project, involving: Rachel Baker (Department of Sociology, University of Edinburgh); Alison Cleland (Napier University); Kathleen Marshall (Centre for the Child & Society, University of Glasgow); Kay Tisdall (School of Political and Social Studies, University of Edinburgh and Children in Scotland).

The Scottish Executive, CRU Legal Studies Branch funded this feasibility study. Main Aims

From a starting point of processes under Part I of the Children (Scotland) Act 1995:
• To examine how best to conceptualize and evaluate how decision-making in children's lives takes account of their views, with particular attention to processes related to Part I of the Children (Scotland) Act 1995 and the implications for compliance with the UN Convention on the Rights of the Child.
• To identify those methodological and practical matters involved in accessing the views of children, those with parental responsibilities and professionals, which will need to be addressed in the next phase of the research.

Key Outcomes
• Mapping where and when, under the whole of the Children (Scotland) Act 1995 and associated regulations and guidance, children's views should be given due regard in decisions which affect them
• Detailed research proposal for the next phase of the research
• A detailed methodology for the next stage of the research
